Sec. 48-11 Duty to Remove Dead, Diseased, and Damaged Trees from Parkway. Sections 48 1-11.
[PDF] Parkway-dedications are an integral part of Dallas’ best tree-lined
neighborhoods. Generally, these areas lie in the area between the
outside edge of the street pavement and the street right of way lines
abutting other public or private property. More commonly, you may know
these areas as the grassy area between the curb and the sidewalk in many
neighborhoods. Trees planted here help create a beautiful, shaded canopy
over the street and sidewalk. Responsibility for these parkway-dedications can often be confusing
as this property is a right of way that is dedicated for public use and
is owned by the city, but maintained by the homeowner. This lack of
clarity can sometimes lead homeowners to think the city maintains the
street trees in parkway dedications--especially when the tree is
damaged. However, according to Section 48-11 of Dallas City Code, if a street
tree is dead, diseased or damaged, the homeowner is actually responsible
for removing this tree. By taking the lead to remove these damaged trees, homeowners help
save valuable taxpayer dollars and encourage ownership of city street
trees. While it is unfortunate to remove a damaged or diseased tree,
especially large beautiful trees, public safety is the city’s priority
